Scope of Services
SafeScape, LLC provides landscape inspection services and fire risk mitigation recommendations to help property owners reduce wildfire risks. Our services are strictly advisory and are not a substitute for professional fire prevention planning, emergency response measures, or compliance with local fire codes and regulations. Our recommendations aim to improve fire resilience but do not guarantee fire prevention. SafeScape, LLC is not responsible for the implementation or maintenance of any recommendations provided. Clients should always follow official guidance from fire safety professionals, emergency services, and regulatory agencies.
SafeScape, LLC makes no guarantees, express or implied, regarding the effectiveness of fire risk reduction measures. the prevention of property damage, personal injury, or loss due to wildfire or other disasters, and the accuracy or completeness of any assessments, reports, or recommendations.
Due to the unpredictable nature of wildfires and environmental conditions, SafeScape, LLC cannot ensure that any property will remain undamaged or safe from fire hazards.
Limitation of Liability
To the fullest extent permitted by law, SafeScape, LLC and its officers, employees, contractors, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, except where such limitation is prohibited by law, including statutory consumer protection claims. This limitation of liability does not apply in states that restrict liability waivers in consumer contracts, including New Jersey and Louisiana. SafeScape, LLC is not liable for any losses due to client failure to implement or maintain risk reduction measures.
Indemnity
Each party agrees to indemnify, defend, and hold harmless the other party from any claims, damages, liabilities, costs, or expenses arising from the other party’s negligence or breach of this agreement, except where such indemnification is limited by state law.
By using SafeScape, LLC’s services, clients acknowledge and agree to follow local, state, and federal fire safety laws and regulations, consult additional fire safety professionals or emergency services for a comprehensive fire mitigation strategy, and implement and maintain any recommended measures at their own discretion and risk. Clients understand that SafeScape, LLC does not perform fire suppression, emergency response, or code enforcement.
Arbitration
By using SafeScape, LLC’s services, you agree to resolve any disputes with us through binding arbitration, rather than in court, except where prohibited by law. Arbitration shall be conducted under the rules of the American Arbitration Association (AAA). Arbitration will take place in your county of residence unless both parties agree to a different location. The arbitrator shall have exclusive authority to resolve all disputes, including those related to the interpretation, applicability, or enforceability of this agreement. Each party shall bear their own legal fees and costs, except as otherwise provided by law. Arbitration shall be confidential and take place on an individual basis. You may opt out of arbitration within 30 days of agreeing to these terms by sending written notice to SafeScape, LLC. The notice must include your name, address, and a clear statement that you opt out of arbitration. Either party may bring claims in small claims court for qualifying disputes. If any provision of this arbitration agreement is found to be unenforceable, the remaining provisions shall remain in effect.
Class Action Waiver
YOU AND SAFESCAPE, LLC AGREE THAT ANY DISPUTE SHALL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND THAT YOU MAY NOT BRING A CLAIM AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person’s claims or preside over any form of a representative or class proceeding. You waive any right to a jury trial and to participate in a class, collective, or consolidated action against SafeScape, LLC. If a court or arbitrator determines that this waiver is unenforceable, then any class, collective, or representative claim must be brought in a court of competent jurisdiction and not in arbitration. This class action waiver is a material part of this agreement and shall survive the termination of your relationship with SafeScape, LLC.
Third Party Services
SafeScape, LLC may provide recommendations that include third-party products, services, or resources. These are for informational purposes only, and SafeScape, LLC does not endorse, guarantee, or assume responsibility for third-party services. Any reliance on third-party products or services is at the client’s own risk. SafeScape, LLC does not provide engineering, architectural, or structural safety assessments, legal, regulatory, or insurance advice, fire suppression or emergency response services. Clients should consult licensed professionals for specific legal, regulatory, or emergency preparedness advice.
SafeScape, LLC reserves the right to modify, suspend, or discontinue services at any time with reasonable notice. Changes shall not apply retroactively to services already rendered mutually agreed in writing by both parties.
These terms shall be governed by and construed in accordance with the laws of the state of California without regard to its conflict of law principles.
